Are prediction markets legal in the US?

There is no single national yes. Sports-event contracts on designated contract markets are in active litigation. A state sportsbook licence is a different legal lane.

In short

Key takeaways

  • There is no single national answer yet; courts and regulators still disagree.
  • Prediction markets sell event contracts on exchanges overseen by the federal CFTC.
  • Several state gaming boards have sent cease-and-desist letters, calling sports contracts unlicensed betting.
  • A licensed sportsbook is different: a state law authorizes it, sets the age limit and publishes the operator list.

  2. 2

    Event contract

What each court actually held (sports-event contracts)

CourtDateHolding in one line
9th Cir. (Nevada)2026-08-28CEA does not displace NV gaming law; § 40.11 bars gaming
6th Cir. (OH / TN)2026-09-25Not “swaps”; CEA does not preempt those states’ gambling law
3rd Cir. (New Jersey)2026-04-06Contracts are swaps; NJ gambling law preempted (PI)

Floor rules

Words that keep the story honest

Know before you sit

Event contract
A listed contract that pays based on whether a stated event occurs. Sports results are the fight in 2026 cases.
Designated contract market
A CFTC-registered exchange that may list commodity derivatives under the Commodity Exchange Act.
17 C.F.R. § 40.11
Current CFTC rule: a registered entity may not list a contract on an excluded commodity that involves gaming or unlawful activity.
Preemption
Whether federal commodities law blocks a state from applying its gambling statutes to those contracts. Circuits split.

Sequence

How to read a “legal here” claim

  1. Step 01

    Name the product

State-licensed sports wager vs an event contract on a designated contract market. They are not the same permit.

  2. Step 02

    Open the state board

If your state licenses sportsbooks, that list is the sports lane. Event contracts are not on it.

  3. Step 03

Read § 40.11 and the circuit

The rule still names gaming. Whether it bars a listing is what the 9th Circuit and the 3rd Circuit disagree about.

  4. Step 04

    Treat proposals as proposals

The June 2026 CFTC notice would rewrite review of event contracts. It is not in force.

Watch outs

Common misreads

  1. 01“Legal in all 50 states”

No. State cease-and-desist letters exist. Three courts of appeals do not agree. That is not a national sportsbook yes.

  2. 02“Same as sports betting”

Sportsbooks sit under state gaming statutes. Event contracts sit under the CEA and CFTC rules. Mixing the maps is the error.

  3. 03“CFTC registration ends state law”

The 9th and 6th Circuits said no for the sports contracts in those appeals. The 3rd Circuit said yes for New Jersey — on a preliminary record.

01Status

Are prediction markets legal in the United States?

There is no single national answer. Sports-event contracts on designated contract markets are in active federal litigation. The Ninth Circuit (Aug 28, 2026) and Sixth Circuit (Sept 25, 2026) declined to treat those contracts as displacing Nevada, Ohio, or Tennessee gambling law. The Third Circuit (Apr 6, 2026) held New Jersey law likely preempted on a preliminary record. This page is orientation, not a ruling on any product.

Are prediction markets legal in all 50 states?

No. State gaming boards have issued cease-and-desist letters treating some sports-event contracts as unlicensed sports wagering. A 50-state sportsbook map does not decide event-contract status. Read your state board and the circuit that covers it, or ask counsel.

02Sports betting vs contracts

Are prediction markets and sports betting the same?

No. A licensed sportsbook is authorized by a state gaming statute, with age, geolocation, and a public operator list. An event contract is listed under commodities rules. Courts disagree whether the Commodity Exchange Act preempts state gambling law for sports-event contracts. Do not treat a CFTC registration as a state sports-wagering licence.

Does CFTC Rule 40.11 ban gaming contracts?

The current text of 17 C.F.R. § 40.11 prohibits a registered entity from listing a contract on an excluded commodity that involves gaming or activity unlawful under state or federal law. The Ninth Circuit and a Third Circuit dissent treat that as a bar. The Third Circuit majority and an Illinois district opinion note the CFTC has not ordered those sports listings off the market. A June 2026 proposal would rewrite the review process; it is not final.

03On this site

Does White Gambling list prediction-market apps?

No. This page is education-only: court opinions, CFTC Rule 40.11, and proposed rulemaking. It names no trading venues, links to no apps, and does not say where to trade. Sports-wagering legality is a separate guide built from state-status statuses.

Is this page legal advice?

No. It summarizes public court opinions and CFTC documents checked for the source pass (Oct 12, 2026) and this review date. Preliminary injunctions are not final merits judgments. For your own situation, read the opinion, contact your state gaming board, or ask qualified counsel.

04More questions people ask

Are prediction markets legal in all 50 states?

They operate nationally under CFTC registration, but several states dispute that for sports contracts and have issued cease-and-desist orders. Legal status for sports contracts is in active litigation in 2026.

Is a prediction market regulated like a sportsbook?

No. A sportsbook needs a state licence and follows state rules on age, geolocation and self-exclusion. A prediction market follows CFTC rules for exchanges.

Which states have legal online sports betting?

As of our October 13, 2026 check, online sports betting is live in 32 jurisdictions: Arizona, Arkansas, Colorado, Connecticut, Delaware, District of Columbia, Florida, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Missouri, Nevada, New Hampshire, New Jersey, New York, North Carolina, Ohio, Oregon, Pennsylvania, Rhode Island, Tennessee, Vermont, Virginia, West Virginia, Wyoming. Every other state either has no law, has a law that has not launched yet, or limits play to a physical venue. Check the state regulator before you deposit, because launches and repeals happen mid-year.

Can I be prosecuted for using one?

We know of no state that has charged an individual user. Enforcement so far targets the platforms. That can change, and this page is not legal advice.
