Daily fantasy sports vs sports betting

Paid fantasy is a contest status. Sports betting is a wager status. A live sports betting status does not make DFS legal, and DFS is not a substitute sportsbook.

In short

Key takeaways

  • Daily fantasy and sports betting are separate products with separate state rules.
  • Fantasy is legal only where your state allows or licenses paid fantasy contests.
  • Pick’em games where you pick over or under on player stats are treated as betting by several regulators.
  • Fantasy sites send Form 1099-MISC once your yearly net winnings pass the IRS reporting line.

01Compare

What is the difference between daily fantasy and sports betting?

Sports betting is a wager licensed (or banned) on the sports betting status. Daily fantasy is a paid contest licensed, registered, or banned on the fantasy status. Counts differ: 32 live sports vs 21 live fantasy (Oct 13, 2026). They are not interchangeable permits.

If sports betting is illegal, is DFS the legal version?

Only if that state’s fantasy status is live and the product is actually a licensed/registered contest. In California both statuses are not legal. Do not use DFS as a slogan for “legal sports betting.”

02Advice

Is this page legal advice?

No. It restates two format statuses from state-status.json. For a personal contest or wager, read the cited statute or ask counsel.

Is pick’em fantasy the same as sports betting?

Several regulators say yes, because you pick over or under on player stats against the house. Some states have ordered pick’em operators out or required a sports wagering licence. Classic salary-cap fantasy against other players is treated differently.

Do I pay tax on fantasy winnings?

Yes. Fantasy prizes are taxable income. Operators send Form 1099-MISC when net winnings for the year reach the IRS reporting threshold.
